On Friday the Employment Tribunal handed down its judgment in the Lord Sugar v Stella English case. Richard Crabtree, Litigation Consultant at Wolters Kluwer UK represented Lord Sugar in a legal capacity throughout the period leading up to and through the case, with Seamus Sweeney acting as Barrister during proceedings.

Andrew Willis, Head of Litigation at Croner says: “Claimants who resign and claim they have been constructively dismissed often allege that the employer breached the contract of employment by conducting itself in a way which undermined trust and confidence between the parties.  In this case the tribunal did not accept many of the allegations made by the Claimant, but also found that even if they had done so the actions alleged were not sufficiently serious to amount to such a breach.  The case is a reminder that a claim of constructive dismissal is not easy to make out, and that employers have discretion in the way they manage their businesses provided they treat employees fairly and reasonably – which in this case the employer did.”
