Following legal challenges from European online recruitment specialist, StepStone, claims made by the online recruitment site Monster have been found to be illegal by courts in Germany.
In the most recent action, Monster has been unable to substantiate its claim to be the largest worldwide career network to the German courts and is no longer allowed to repeat this claim in Germany. The ruling followed a complaint made by StepStone that Monsterís leadership claims could not be evidenced against objective criteria. The Landgericht Hamburg pronounced its first instance judgement last week, following Monsterís admission of StepStoneís complaint. The judgement is subject to a possible appeal to a court of second instance.
Previously, in April this year, StepStone successfully won a separate ruling relating to earlier unfair claims made by Monster in Germany. Under the preliminary injunction granted at that time, Monster was not allowed to repeat certain misleading statements about its reach based on misuse of market research data published by Nielsen. This preliminary judgement was confirmed in a first instance judgement on 3rd November 2005 which is subject to a possible appeal to second instance courts.
