IR35 - Risk around the corner

The BBC indicates that the government is likely to extend the IR35 public sector rules to the private sector in the forthcoming budget. Whether the BBC is right or not remains to be seen, but see here (link) an article from our legal partner Lawspeed.

IR35 remains a key subject for most agencies supplying contractors. Whilst liability for the tax currently rests with the contractor working in the private sector, that may change if the extension to the private sector goes ahead. ARC will continue to press the government to adopt proposals that are less invasive than those applying in the public sector, and in particular suggests that a business test would be more appropriate.
